These terms and conditions govern the provision of the services offered by NearVisual. By requesting, quoting or contracting any service, the client expressly agrees to be bound by these conditions.
1. Purpose and scope of services
NearVisual provides professional web design, graphic design, branding, social media management, and artificial intelligence consulting and implementation services. The exact scope of each project is defined individually through a written proposal or an agreed message via WhatsApp/email before work begins.
2. Contracting and payment process
All projects and services, without exception, are governed by an advance payment and final settlement scheme, structured as follows:
- Deposit (50%): Required to reserve the slot in the schedule and start the project. Non-refundable once diagnostic or design work has begun.
- Final payment (50%): On delivery, or before the release of final files, passwords or the deployment of websites to production.
3. Change of scope (scope creep)
Quoted prices cover only the scope detailed in the original proposal. Any request for additional work, new sections on a website, extra graphic pieces or revision rounds beyond those agreed will be quoted and invoiced separately before being carried out.
4. Intellectual property
The client acquires the rights of use and commercial exploitation of the designs, code or pieces delivered only after 100% of the project has been paid in full. NearVisual reserves the right to display completed work in its portfolio, website and social media for promotional purposes, unless a strict non-disclosure agreement (NDA) is signed.
5. Confidentiality
All information provided by the client regarding their business, finances, internal processes and passwords will be treated in strict confidence and used solely for the purposes of the contracted project.
6. Cancellation and refund policy
If the client decides to cancel the project once work has begun, the initial 50% payment will not be refunded, as it covers the time and effort already invested in initial research and development. Should NearVisual be forced to cancel the project due to force majeure, a refund proportional to the uncompleted work will be issued.
7. Limitation of liability
NearVisual provides tools, design and strategies aimed at commercial growth; however, does not guarantee any specific level of sales or income, since these depend on market factors, the client's own commercial execution and external conditions beyond our control.
8. Governing law and jurisdiction
For the interpretation and fulfilment of these Terms and Conditions, the parties submit to the applicable laws and the competent courts of the city of Mérida, State of Yucatán, Mexico, expressly waiving any other jurisdiction that might apply to them by reason of their present or future addresses.
